EB1A Immigration

  • In the United States, EB1A (Alien of Extraordinary Ability), an umbrella category under Employed-based permanent residency, is available for foreign nationals who have achieved national or international acclaim in the arts, sciences, education, business, and athletics.

  • They are eligible to self-petition without an employment offer in the U.S. However, they must intend to work in the same field and must show how their expertise will be beneficial to the country.

A visa can be granted to three types of people

  • Those who have achieved sustained national or international acclaim with documented achievements in the sciences, arts, education, business, or athletics.

  • An outstanding professor or researcher has “been recognized internationally for their outstanding academic achievements in a particular field” and has been teaching or conducting research in that area for at least three years. The applicant must also hold a tenured or tenured track teaching or comparable research position at a university or other higher education institution.

  • Some executives and managers of foreign companies who are transferred to the U.S. must have worked for at least one year in a managerial position outside of the United States during the last three years in the same company or a related company outside of the US.

To prove extraordinary ability in a field, an applicant must meet 3 of the 10 criteria listed below

  • Evidence of receipt of lesser nationally or internationally recognized prizes or awards for excellence

  • Evidence of membership in professional organizations that demand outstanding achievement from their members

  • Evidence of published material about you in professional or major trade publications or other major media

  • Evidence of judging the work of others, either individually or on a panel

  • Evidence of original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field

  • Evidence of authorship of scholarly articles in professional or major trade publications or other major media

  • Evidence that work has been displayed at artistic exhibitions or showcases

  • Evidence of performance in a leading or critical role in distinguished organizations

  • Evidence of high salary or other significantly high remuneration in relation to others in the field

  • Evidence of commercial success in the performing arts
