A Commissioner of Oaths

When you sign an affidavit or statutory declaration, we are authorized by the Province of Ontario to take an oath. This authority is granted to us under the Commissioners for Taking Affidavits Act. However, it is not our responsibility to review the affidavit.

  • Client's responsibility

    If you are signing a legal document that requires your oath, you are solely responsible for its content. In placing an affidavit on oath, you are called the deponent - the person signing it. By swearing an oath, you are attesting to the accuracy of the details in the document to which you are attesting.

We can sign the following documents

affidavits and statutory declarations related, but not limited to the following:

  • Consents to travel

  • Declaration regarding residency (with accompanying documentation)

  • Vehicle transfers

  • Change or proof of vehicle ownership

  • Insurance claims

  • Pension plan documents

  • Statutory declarations on government-related forms

  • Commissioners of Oaths may choose to sign or not sign documents based on their own discretion if they are uncertain of the deponent's identity or document content. Generally, documents from outside of Ontario or Canada do not offer the option of a Commissioner of Oaths. Therefore, the City cannot assure that the authority of a Commissioner of Oaths will be recognized.

We can not sign the following documents.

  • Real estate transactions and land transfers

  • Passports and related documents in certain situations

  • Certification of documents

  • A form that requests an oath from the commissioner and includes certified true copies of other documents as attachments.
